  1. California passes regulations that address pesticides.  These regulations are much stricter on the use and production of pesticides than the federal regulations.  Is this permissible under current law?  What if California’s regulations are much less strict than the federal regulations?

Under current law, California is generally allowed to pass stricter pesticide regulations than federal law, as long as they do not conflict with or undermine federal regulations. However, if California’s regulations were less strict than federal regulations, they would likely be preempted. Under FIFRA, states cannot permit a pesticide that the Environmental Protection Agency (EPA) has banned or regulate it in a way that is less protective than federal standards. Federal law sets a minimum threshold of safety, and states may go beyond it but not fall below it.
