Addressing Unauthorized Patient Photography Issues

If you were the privacy officer in your organization how would you address the following?

It has been my experience that this data is generated and stored in the computers by my facility, and that it can be retrieved. IT when and if necessary, but it does not undergo any routine auditing or assessment.  In fact, it has only become an issue when there has been a breach or suspected breach of data security.  This is a problem and I believe there should be regular and repeated assessments of who uses what computer where and when.  Whether this be a weekly or monthly audit, one of the two should be performed.

You observe one of the healthcare professionals using his smartphone to take pictures of a patient. He sees you and says in front of the patient,

The actions of this employee are highly unprofessional. And not only violate the patient’s privacy but could cause emotional harm to the patient. The reasoning behind taking photos should be considered. However, this scenario makes me feel that the photo is not for medical reasons. As a nurse, it is imperative to protect the privacy and security of patients. All nurses must maintain the right to privacy and maintain confidentiality for patients.

Things to consider would be tattoos, birthmarks, scars, clothing, piercings, and background items in the photo

There could be numerous items in the room that could identify the patient being photographed. I would refer to the facility’s policies on the photography of patients as well as the use of phones inside the facility. This scenario seems to include not only a violation of patient privacy but also possible disciplinary action for use of a cell phone inside the facility. It is vital for organizations to have clear policies and training for employees regarding these issues. Employees should be trained and educated on the facility’s policy regarding photography and the use of cell phones, as well as the potential consequences of violation. APA
